Terms of Use and Sale
Purpose
These terms of use and sale govern access to the ChessPivot service, its use and the sale of the Plus subscription, published by Mathieu Morio (see the Legal notice).
Acceptance
By using ChessPivot, you accept these terms. If you do not agree with them, do not use the service.
The service
ChessPivot analyses your chess games (imported from Chess.com or Lichess, or pasted as PGN), identifies recurring weaknesses and offers exercises and a training plan.
Some features are free; others require the Plus subscription.
Account and access
Some features require a username or an account. You are responsible for its use and undertake to provide accurate information.
Plus subscription
Plus is offered on a monthly or yearly plan, at the prices shown on the Pricing page.
Payment is handled by Stripe. The subscription renews automatically at term unless cancelled before the end of the current period.
You can cancel at any time from your account; cancellation takes effect at the end of the period already paid, with no pro-rata refund.
As the digital service is supplied immediately with your express consent, the 14-day right of withdrawal no longer applies once Plus access is opened.
Prices and billing
Plus subscription prices are shown in euros, all taxes included. The applicable VAT is collected and remitted by Stripe, the merchant of record for the transaction.
An invoice is made available after each payment.
Legal guarantee and complaints
The service benefits from the legal guarantees provided by consumer law. Any complaint can be sent to contact@chesspivot.com; we endeavour to respond promptly.
Consumer mediation
In accordance with the French Consumer Code provisions on the mediation of consumer disputes, after contacting us and failing a response that satisfies you, you may use a consumer mediation procedure free of charge with:

Intellectual property
Service content (analysis, text, design, brand) is protected. You receive a personal, non-exclusive right of use, with no right to resell or redistribute.
Acceptable use
You undertake not to disrupt the service, attempt unauthorised access, or extract its data in bulk.
Personal data
How your data is processed is described in the Privacy Policy.
Availability and liability
The service is provided "as is", without warranty of continuous availability or freedom from error. Analyses are provided for guidance and ChessPivot cannot be held liable for the consequences of their use.
Compute contribution
To speed up game analysis, ChessPivot may use part of your computer’s spare power, through your browser, to evaluate chess positions. This contribution only runs on a desktop computer, never uses all of your resources, may run while the tab stays open (including in the background), pauses on battery and while you are analysing a game yourself, and processes no personal data (only anonymous chess positions).
Changes to these terms
These terms may change. The applicable version is the one online at the time you use the service.
Governing law
These terms are governed by French law. Failing an amicable resolution, the French courts have jurisdiction.
